The statute of limitations to file a mesothelioma claim varies by state. For instance, Tennessee and Kentucky give you just one year from diagnosis to file a personal injury lawsuit and one year after death to file a wrongful death claim. Similarly, Virginia, Illinois, Florida, and Arizona give you two years from either the date of death or the date of diagnosis, while Wisconsin gives you three years to file for both.

No matter where you live, these deadlines are strict and final. The limitation for each begins from the date of diagnosis or death—not the date of exposure—to acknowledge the disease’s long latency period.

For some states like Tennessee and Florida, manufacturers may be shielded by a “bare metal” defense unless it is found that the exposure is directly tied to asbestos-containing products.
