Many people don’t even know that they could be injured by a vaccine. This is largely due to the fact that most people don’t suffer any serious side effects from receiving one of these life-saving, preventative injections. In the 1970’s, multiple legal cases were filed against healthcare providers and manufacturers of the vaccine diphtheria, pertussis, tetanus (DPT) for injuries caused by this injection. This brought vaccine production to a halt, effectively causing a shortage in vaccines and leading healthcare providers and state leaders to wonder if they were going to have a preventable pandemic on their hands as a result. In 1986, the National Childhood Vaccine Injury Act was passed, putting in place a system called the National Vaccine Injury Compensation Program (NVICP). This is a no-fault program that compensates those who have been injured by a vaccine. It essentially lets manufacturers continue to distribute vaccines, while providing compensation to people who suffer injuries.

  • Shoulder Injury — If you experience a negative reaction to a vaccine injected into your shoulder, you may face frequent soreness, or even a complete loss of use of that shoulder. Common shoulder injuries caused by vaccines include frozen shoulder syndrome, adhesive capsulitis, rotator cuff tears, shoulder bursitis, and more.
  • Guillain-Barré Syndrome — Perhaps the most common injury to be developed from a vaccine, Guillain-Barré syndrome has been largely linked to the flu shot. It is an injury that causes your immune system to turn on itself, causing damage to nerve cells.
  • Chronic Arthritis — If you’ve taken a combination vaccine containing the rubella virus, you may be at risk for developing chronic rheumatoid arthritis. Symptoms of this include joint pain and swelling.
  • Encephalitis — This is when a vaccine causes an infection that affects brain inflammation. The claim holder may experience headaches, fatigue, fever, weakness, and more.
  • Anaphylaxis — If a person has an extreme allergic reaction to a vaccine, they may experience itchy hives and a swollen throat.
  • Transverse Myelitis — This injury includes inflammation of the spinal cord that could result in damage to motor and sensory skills. If you are suffering from Myelitis, you may experience blurred vision, pain, weakness, depression, paralysis, and more.

  1. File a petition with the U.S. Court of Federal Claims
  2. The U.S. Department of Health and Human Services medical staff will review your petition and determine if you are eligible for compensation.
  3. The U.S. Department of Justice will then file a report with the court.
  4. This report is then presented to a court-appointed special master who will decide whether or not the injured individual will receive compensation. This person will also determine the amount that is to be compensated.
  5. If compensation is granted, the court will order the U.S. Department of Health and Human Services to proceed with a settlement.
